Contradictions In Oral And Written Car Shipping Agreements

When you are doing business with a vendor or a service merchant, it is important to note all aspects of your deal. You should pay close attention to the money and the stipulations involved in the deal. This is even more important when you have to secure these goods and services up front. Sometimes, the merchant may try to tell you things over the phone that you may like to hear, or that is presented in a way that does not make very much sense when spoken. Oral and written car shipping agreements are no exception to this rule either. If something is promised in speech but not shown in the contract, then you should take the matter seriously.

If you are speaking to a representative of the auto shipping service in person or on the phone, be sure to take notes of what is agreed upon in speech as well as the name of the person you spoke to. You will also want to record the date and time for further reference. Also, if any money is paid to the car shipping service before they complete their service, always be sure to obtain a receipt.

Once you are presented with the written contract, read it very carefully. The written contract will usually be what the company will be willing to offer, and if you were promised something and it is not reflected in the written contract, then bring it to the attention of the auto shipper that you were promised something other than what is shown on paper.

Usually, if the shipping company will work with you for any dispute you may have. If the oral agreement is fair and was promised, then the company will usually amend the contract to show what is promised to you. If the company is unable to change the written agreement to suit what you were promised orally, then do not sign that contract.

If you do sign it and there is a discrepancy later on, then you will not have a chance to alter the agreement to your favor, especially since a worded document is clear and shows the details of the contract of service. After the service is performed, then it becomes even harder, as most companies will never honor oral agreements versus written contracts.

Your written contract will always be the one that you should go by, no matter what you are promised from another person. Make sure that you obtain a copy of your contract, especially if there are any changes or amendments made. In contracts, it takes a lot more to prove an oral contract exists than it does for a written one, so if promises of services are made, then you should always strive to obtain it in writing.
